It is a sad but true fact that accidents that happen early in the morning, frequently involve alcohol. Alcohol may have been a contributing factor in this crash. Victims’ families are often left to wonder how to move on and what to do when a loved one is taken suddenly in an accident. That is why Texas has passed legislation that holds an alcohol provider, such as a nightclub, bar, or restaurant, liable for someone’s injuries or death if they were responsible for overserving that person before a crash. Many times, an independent investigation is necessary to preserve evidence and determine where they were drinking. It is imperative to gather the evidence quickly before it is tempered with or lost. Such things as video surveillance from the establishment or neighboring properties and witness statements are crucial in the Dram Shop cases.
