San Antonio – August 26th, 2022, Two women involved in an early morning rollover crash in Northeast Bexar County
The wreck occurred in the 9400 block of Bending Crest, near New World Drive and Crestway Drive, just outside of Windcrest City Limits, around 3:00 am. Deputies say the driver of the vehicle hit a parked car for an unknown reason, which led to her car flipping over.
2 women, believed to be in their late 30s or early 40s, had to be cut free from their vehicle by Windcrest and Bexar County firefighters. Both women were taken to a hospital with non-life-threatening injuries. There were no other injuries reported.
Bexar County’s Sheriff’s Office reported that at this time the cause of the car crash is unclear, and the investigation is ongoing.
At this time, police cannot say what caused the accident because they are still gathering information to piece together what happened. While it is tempting to blame the driver for common causes such as texting, intoxication, and speeding, we must recognize that there are other possibilities.
However, if alcohol was a factor in the crash, Texas has a Dram Shop law, which holds an alcohol provider, such as a bar, restaurant, or package store, liable for someone’s injuries or death if they were responsible for overserving that person prior to the crash. If this occurs, the victim or their family has the right to hold the company accountable for their role in the crash.
If the cause of a crash appears to be alcohol-related, a thorough investigation is required to preserve evidence and determine whether the driver became intoxicated at a place of business. It is critical to determine this early on so that authorities can collect items such as video surveillance and witness statements before they are forgotten, deleted or destroyed. Dram Shop cases are beneficial to society because they discourage bars and restaurants from over serving in the future.
